The Australian Criminal Intelligence Commission (ACIC) is seeking to appoint two full-time Examiners and one part-time Examiner.
The ACIC is uniquely equipped as Australia’s national criminal intelligence agency with investigative, intelligence collection and information delivery functions. The ACIC works closely with national and international partners to achieve its vision of a safer Australia that is better connected, informed and capable of responding to crime and criminal justice issues.
Taking account of criminal threats to Australia, and our stakeholders’ needs, the ACIC creates a national intelligence picture of crime, targets serious and organised crime, and delivers information capability and services to front line police and law enforcement.
Amongst its specialised information collection powers, the Australian Crime Commission Act 2002 provides that ACIC Examiners may exercise a number of coercive powers where the Board of the ACIC has authorised a special ACIC operation or investigation. These powers include summonsing persons to give evidence, issuing notices to produce documents and things, requiring information from government bodies, and making applications to courts for the production of passports or issuing of search warrants.
Examiners also preside over coercive examinations, ensuring the lawful and proper exercise of the ACIC’s coercive powers. Examiners may only exercise their powers for the purpose of a special ACIC operation or investigation. Before exercising their powers, Examiners must be independently satisfied that it is reasonable in all the circumstances to do so. Their decisions are subject to judicial review and are regularly tested and challenged before the Courts.
This is a senior statutory appointment within the ACIC and applicants need to demonstrate a high degree of expertise in the areas relevant to these functions.
The principal accountabilities and responsibilities include:
- exercising statutory authority to issue a summons to a person to appear at an examination and to produce documents or things, or to issue a notice to a person to produce documents or things
- regulating the conduct of examination proceedings
- regulating the legal representation of persons giving evidence before an Examiner
- determining legal issues arising during examinations
- giving directions as to the confidentiality of examinations
- making evidence available to a relevant court if the court gives a certificate to the Examiner to that effect
- giving the head of the special ACIC operation or investigation a record of the proceedings of the examination and any documents or other things given to the Examiner in connection with the examination.
The successful candidate will demonstrate:
- high level leadership and vision
- experience managing large and/or complex operations
- ability to work with others to meet objectives
- high level judgement
- high standard of professional and personal integrity and capacity to promote these in an organisation
- demonstrated knowledge of, and experience in, advanced investigative and interview techniques.
To be eligible for appointment as an Examiner, applicants must:
- be enrolled as a legal practitioner and have been so enrolled for at least 5 years
- be an Australian citizen, unless the agency head has agreed otherwise in writing
- receive and maintain, or continue to hold, a Negative Vetting Level 2 security clearance
- disclose all interests, pecuniary or otherwise, that may conflict with the performance of their duties, including any other place of employment
- demonstrate willingness and capacity to work within the ACIC operational environment and undertake interstate travel, including, on occasion, to remote locations
- satisfy an ACIC Organisational Suitability Assessment (OSA) before being offered a role.
Given the ACIC’s role, powers and access to information, staff must meet the highest integrity standards and accountability. The OSA is specific to the ACIC and separate to the security clearance process.
Possible locations for full-time Examiners include Sydney NSW, Brisbane QLD and Melbourne VIC. The location of the part-time Examiner is flexible and includes any capital city excluding Darwin or Perth.
